Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• “Affiliate” means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• “Country” refers to: United Kingdom
• “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Estate Visuals..
• “Device” means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• “Service” refers to the services provided by the Company, including but not limited to property photography, videography, and virtual tours, as detailed on our Website.
• “Terms and Conditions” (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• “Website” refers to Estate visuals, accessible from https://www.estatevisuals.uk/
• “Work” is defined as all photographs, videos, 3D content, floor plans, graphics, and other visual content of the property produced under these terms.
• “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. By ordering any of our Services, you agree to be bound by these Terms.

Service Policies

Appointments & Property Readiness

You are responsible for ensuring the property is “camera ready” for the scheduled appointment time. This includes all cleaning, decluttering, and staging. If our photographer arrives and the property is not ready, it will be shot “As Is”.

We welcome your input on specific angles or features you wish to highlight. Please be present at the beginning of the appointment to discuss this with the photographer or include detailed notes in your order. Absent your specific input, our photographer will use their professional judgment to capture the property in its best light.

Cancellation & Rescheduling

Confirmed appointments that are cancelled or rescheduled within 24 hours before the shoot are subject to a £75 fee.

Appointments that cannot be completed due to hazardous weather conditions (e.g., heavy rain, high winds preventing drone operation) will be rescheduled at the earliest available opportunity with no fee.

Payment Terms

An invoice will be issued upon delivery of the final Work. Payment is due within 7 days of the invoice date. The final, delivered media will not contain any watermarks.

If an invoice remains unpaid for over 45 days, all media assets related to the account will be deactivated, and no new orders can be placed until the outstanding balance is paid in full. Accounts with balances outstanding for over 90 days will be referred to a collections agency.

Service Area & Travel Fees

Our standard service area covers a 50-mile radius from Norwich. Travel within the first 10 miles is included free of charge. For distances beyond 10 miles, a travel fee of £0.50 per mile will be applied for the entire round trip.

Media Delivery & Hosting

Delivery Times:

• Next Business Day: HDR Photography, Floorplans, Aerial/Drone Photos & Videos, Twilight Photography, Vertical Photos.
• Second Business Day: Video Tours, Social Media Reels, Virtual Staging.
• Up to Three Business Days: 360° Virtual Tours, 3D Floorplans.

Hosting Policy: We will host the media created for you for a guaranteed period.

• Photographs & Videos: One year from the date of the appointment.
• 360° Virtual Tours (Matterport): Six months from the date of the appointment.

After this period, you are responsible for downloading and storing your media. We are not responsible for storing media beyond these guaranteed hosting times.

Rights and Usage

Grant of Rights

You grant to Estate Visuals a non-exclusive, perpetual, worldwide right to create, reproduce, display, and distribute the Work for our company’s portfolio, samples, self-promotion, and editorial use. All copyright and ownership rights in the Work remain with Estate Visuals.

Usage Rights

In return, Estate Visuals grants you a non-exclusive, non-transferable license to use the delivered Work for the sole purpose of marketing and promoting the specific property listing. This license is valid for the duration of your active listing of the property. You may provide the Work to third-party websites (e.g., MLS, property portals) for this purpose.

This license does not permit you to sell, gift, or transfer the Work to any third party, including another agent, the property owner, or a stager, for their own use.

Releases and Authorizations

By contracting our services, you warrant that you have obtained all necessary permissions from the property owner to grant us access to photograph and film the property, and to use the resulting Work as outlined in these Terms. You agree to indemnify and hold harmless Estate Visuals against any claims or costs arising from a breach of this warranty.

General Legal Terms

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to the use of our Service.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind.

Governing Law

The laws of the United Kingdom shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect.
